AGREEMENT TO TERMS

Disco is not a healthcare provider.

Disco does not:

Practice medicine

Provide healthcare services

Diagnose conditions

Treat diseases

Prescribe medications

Recommend treatment plans

Monitor health conditions

Provide clinical judgment

Provide emergency services

All healthcare decisions remain solely the responsibility of the user and the user's healthcare providers.

NO MEDICAL ADVICE

The Services are provided solely for informational, educational, discovery, navigation, and marketplace purposes.

Nothing available through the Services constitutes:

Any healthcare relationship exists solely between the user and the applicable provider.

Disco does not monitor emergency communications.

USER ACCOUNTS

Certain features require a user account. Users agree to provide accurate and current account information, safeguard their credentials, and promptly notify Disco of suspected unauthorized access.

Users are responsible for activity performed through their accounts and may not share credentials or permit others to access the Services through their accounts.

Disco may suspend, restrict, or terminate an account when reasonably necessary to address a violation of these Terms, misuse, fraud, a security risk, a legal requirement, or conduct that may harm Disco, its users, or third parties.

Users may stop using the Services or request account deletion, subject to applicable legal, security, and data-retention requirements described in the Privacy Policy.

USER SUBMISSIONS

Users may provide private information and inputs through account features, including health and wellness information, artificial intelligence conversations, feedback, board names, saved items, and similar submissions ("User Submissions"). Regular user accounts cannot publish videos or other contributor content.

Disco processes User Submissions as described in the Privacy Policy and in accordance with the permissions users provide. User Submissions are not public creator content unless a feature clearly discloses that information will be shared and the user affirmatively chooses to share it.

CONTRIBUTOR ACCOUNTS AND CONTENT

Only approved contributor accounts may submit content for publication through the Services, including profile information, videos, images, text, educational content, product or service listings, recommendations, and links ("Contributor Content").

Contributors retain ownership of their Contributor Content. By submitting Contributor Content, contributors grant GenWell, Inc. d/b/a Disco a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, adapt, display, distribute, and promote that content as reasonably necessary to operate, improve, and market the Services and to make the Contributor Content available through the Services.

Contributors represent that they have all rights and permissions necessary to submit Contributor Content and that their content and associated claims comply with applicable law and these Terms.

Disco may review, format, restrict, decline to publish, or remove Contributor Content and may suspend contributor access for violations of these Terms, legal requirements, safety concerns, or platform-integrity concerns. Disco is not obligated to publish or retain any Contributor Content.

Additional contributor, supplier, partner, or marketplace terms may apply. If those additional terms conflict with these Terms regarding contributor activities, the additional terms control for those activities.

FEEDBACK

Any feedback provided to Disco may be used without restriction or compensation.

INTELLECTUAL PROPERTY

The Services and all related intellectual property are owned by Disco or its licensors.

ACCEPTABLE USE

Users may not:

Violate laws

Misrepresent identities

Scrape the platform

Reverse engineer systems

Circumvent security measures

Submit unlawful content

Abuse AI features

THIRD-PARTY SERVICES

Disco is not responsible for third-party websites, providers, products, services, content, or integrations.

DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISCO DISCLAIMS ALL WARRANTIES, INCLUDING:

DISCO'S AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF:

(A) $100; OR

(B) THE AMOUNT PAID BY THE USER TO DISCO DURING THE PRECEDING TWELVE MONTHS.

INDEMNIFICATION

Users agree to indemnify and hold harmless Disco from claims arising out of:

Violation of these Terms

User content

Interactions with providers

Interactions with products

Violations of law

GOVERNING LAW

These Terms shall be governed by Delaware law.

DISPUTE RESOLUTION

Any dispute arising from the Services shall be resolved through binding individual arbitration.

Users waive participation in class actions to the fullest extent permitted by law.

CHANGES TO THE SERVICES

Disco may modify or discontinue Services at any time.

CHANGES TO THESE TERMS

Disco may modify these Terms at any time.
